My recent successes include: An executor allowed a bank to foreclose on the decedent's home after being wrongly told by the bank that the home value would not exceed the amount of the loan. The sale proceeds exceeded the amount owed, but the excess proceeds had not been returned to the estate. I forced the bank to return the excess proceeds. The Internal Revenue Service attempted to assess several hundred thousand dollars in taxes against an estate. I asserted defenses and pointed out errors on the IRS' part, stopping the IRS's levy process. As part of a team, representing a fiduciary against estate beneficiaries who believed he had wrongly invested estate assets. At stake are claims for several millions of dollars. After almost 4 years in litigation, the plaintiffs have not won a single victory against the fiduciary. Representing a commercial borrower in a revolving line of credit dispute. I filed suit when the lender refused to comply with the terms of the lending contract. Forced to face their own breach of contract, the lender settled the matter for 42% of the amount of the outstanding loans (which amounted to millions of dollars).
