Since the late s, Michael A. Sullivan has worked with the nation's major whistleblower law, the False Claims Act. After defending whistleblower cases, he now represents whistleblower clients who report fraud against the federal or state governments or against investors. He was asked by legislators to help draft and explain Georgia's state versions of the False Claims Act, the State False Medicaid Claims Act and the Georgia Taxpayer Protection False Claims Act, . He also is one of the first lawyers to represent clients in the new IRS Whistleblower Program, and he has submitted tax whistleblower claims totaling billions of dollars. He has testified before the IRS on its proposed whistleblower rules, and has appeared with the Director of the IRS Whistleblower Office to educate lawyers on a variety of issues that arise in pursuing IRS Whistleblower claims. His interview with IRS Whistleblower Office Director Stephen A. Whitlock on Best Practices in Pursuing IRS Whistleblower Claims appeared in the April False Claims Act Qui Tam Quarterly Review. When Congress sought to create a new SEC Whistleblower program through the Dodd-Frank bill enacted in , representatives of the U.S. Senate Banking Committee contacted Mr. Sullivan for input on what an effective whistleblower program should include. Since Dodd-Frank's passage, he has also met and discussed the rules for the new SEC Whistleblower program with SEC Chairman Mary Schapiro, Director of Division of Enforcement Robert Khuzami, and SEC staff, as well as Commissioners Luis A. Aguilar, Kathleen L. Casey, Troy A. Paredes, and Elisse B. Walter. He has also met with the Chair of the CFTC Gary Gensler and senior staff to discuss its proposed whistleblower rules. The final rules issued by both the SEC and CFTC incorporated important changes that he advocated. Mr. Sullivan now also represents whistleblowers in SEC and CFTC Whistleblower claims, with total claims in the billions of dollars, Specialties Representing whistleblowers who pursue qui tam cases under the False Claims Act, IRS whistleblower claims under the new IRS Whistleblower Program, and whistleblower claims under the SEC and CFTC Whistleblower Programs.
